Welcome to Chat Pro, a service provided by Apptify LLC (“we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our website and services at chat-pro.org (collectively, the “Service” or “Chat Pro”). By accessing or using Chat Pro, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

I. Acceptance of Terms

These Terms constitute a legally binding agreement between you (“you” or “User”) and Apptify LLC. We may update these Terms from time to time, and the updated version will be posted on this page with a revised effective date. Your continued use of Chat Pro after such changes signifies your acceptance of the updated Terms.

II. Eligibility

To use Chat Pro, you must:

• Be at least 13 years old. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian.
• Not be prohibited from using the Service under applicable law or by us due to prior violations of these Terms.

III. License to Use the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Chat Pro for personal, non-commercial purposes, subject to these Terms. You may not:

• Copy, modify, distribute, or reverse-engineer the Service.
• Use the Service for any illegal, harmful, or unauthorized purpose.

IV. User Accounts

• Registration: You may need to create an account to access certain features of Chat Pro. You agree to provide accurate and complete information during registration and to keep it updated.
• Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at support@chat-pro.org if you suspect unauthorized use.
• Termination: We reserve the right to suspend or terminate your account at our discretion, especially for violations of these Terms.

V. User Content

Ownership: You retain ownership of any text, images, PDFs, or other content (“User Content”) you upload to Chat Pro. By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and display it as necessary to provide the Service.

Responsibility: You are solely responsible for your User Content. It must not:

• Infringe on third-party rights (e.g., copyright, privacy).
• Contain illegal, offensive, or harmful material.
• Violate these Terms or applicable laws.

Text: This includes any text you enter into the message field or upload to Chat Pro in supported formats such as PDF, DOCX, DOC, CSV, PPTX, PPT, TXT, XLSX, XLS, and FB2 (Input Text Content), as well as any text generated as Output Text Content by Chat Pro.

Images: This includes any images you upload to Chat Pro in supported formats such as PNG, JPEG, and WEBP (Input Image Content), as well as any images generated as Output Image Content by Chat Pro.

Subject to your compliance with the terms and conditions set forth in our Terms of Use, you are permitted to dispose of, use, share, or otherwise exploit your Output Content for your own purposes. However, please note that you do so at your own risk, and you assume full responsibility for any consequences related to the use of User Content. It is your responsibility to ensure that your use of User Content complies with applicable laws. Please also be aware that we work with third-party service providers, such as OpenAI, L.L.C. and Anthropic, PBC, for the processing and creation of AI-generated User Content.

We may remove or restrict access to User Content that violates these Terms at our sole discretion.

VI. Prohibited Conduct

You agree not to:

• Use Chat Pro to harass, defame, or harm others.
• Upload viruses, malware, or other harmful code.
• Attempt to gain unauthorized access to our systems or data.
• Use the Service for commercial purposes without our prior written consent.
• Scrape, extract, or collect data from Chat Pro for any purpose not expressly permitted.

VII. Intellectual Property

All content, software, and materials on Chat Pro (excluding User Content) are owned by or licensed to Apptify LLC and protected by copyright, trademark, and other laws. You may not use our trademarks, logos, or other proprietary content without our written permission.

VIII. Third-Party Services

Chat Pro may integrate with or link to third-party services (e.g., Apple ID, Google login). Your use of these services is subject to their respective terms and policies, and we are not responsible for their operation or content.

IX. Payments and Subscriptions

• Fees: Some features of Chat Pro may require payment. All fees are non-refundable unless otherwise stated.
• Billing: If you subscribe to a paid plan, you authorize us to charge your payment method according to the agreed terms. You are responsible for any applicable taxes.
• Cancellation: You may cancel a subscription at any time, but no refunds will be issued for unused portions unless required by law.

X. Disclaimer of Warranties

Chat Pro is provided “as is” and “as available.” We disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

XI. Limitation of Liability

To the maximum extent permitted by law, Apptify LLC, its affiliates, and their respective officers, employees, or agents will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of Chat Pro, even if advised of the possibility of such damages. Our total liability to you will not exceed the amount you paid us (if any) in the 12 months preceding your claim.

XII. Indemnification

You agree to indemnify and hold Apptify LLC harmless from any claims, losses, or damages (including legal fees) arising from your use of Chat Pro, your User Content, or your violation of these Terms or applicable laws.

XIII. Termination

We may terminate or suspend your access to Chat Pro at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your license to use the Service ends, and you must cease all use of Chat Pro.

XIV. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Chat Pro will be resolved exclusively in the state or federal courts located in Dade-County, Florida. You waive any objections to jurisdiction or venue in such courts.

XV. Miscellaneous

• Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and us regarding Chat Pro.
• Severability: If any provision of these Terms is found invalid, the remaining provisions remain in effect.
• No Waiver: Our failure to enforce any right or provision does not waive that right or provision.
